•Patient Information: Information you provide, or authorize the release of, to us, including medical reports, scans, CDs, images, notes, and tests. Patient Information also includes information that you provide about any of these reports, scans, CDs, images, notes, and tests, including annotations, interpretations, labels, dates, and notes.
•Genetic Information: Your Genetic Information includes your DNA information, as well as information relating to your DNA, such as genetic markers that may indicate certain traits. Processing and disclosing genetic data is subject to applicable state and federal requirements, including obtaining specific consents where required.
•Voluntary Information: Information you provide to us voluntarily by completing web forms, participating in polls, or contributing to blogs, postings, and other mediums constitutes Voluntary Information.

‍Sensitive Information. When necessary, with your consent or as otherwise permitted by applicable law, we process the following categories of sensitive information. social security numbers or other government identifiers.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Information automatically collected
‍In Short: Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.

Because we work with health systems and research partners, certain information we collect or receive about you may qualify as Protected Health Information (“PHI”) under the Health Insurance Portability and Accountability Act of 1996 (HIPAA). This section explains how we use and share PHI and the rights you have with respect to that information.

How We Use PHI

•Supporting health system operations, including workflow improvement, patient outreach, and quality initiatives;

•As required by law, including to public health authorities, regulators, or in response to valid legal processes.

We use reasonable administrative, technical, and physical safeguards designed to protect the confidentiality, integrity, and security of PHI in our possession.

2. HOW DO WE PROCESS YOUR INFORMATION?

• To post testimonials. We post testimonials on our Services that may contain personal information.

• To protect our Services. We may process your information as part of our efforts to keep our Services safe and secure, including fraud monitoring and prevention.

• To evaluate and improve our Services, products, marketing, and your experience. We may process your information when we believe it is necessary to identify usage trends, determine the effectiveness of our promotional campaigns, and to evaluate and improve our Services, products, marketing, and your experience.

• To identify usage trends. We may process information about how you use our Services to better understand how they are being used so we can improve them.

• Our projects may include studying the clinical characteristics of a condition or disease, analyzing subgroups or cohorts of patients within a condition, and conducting or supporting the development of a drug, device, or diagnostic. We may commercialize this knowledge to improve our understanding of the condition or disease as well as to advance health care to better diagnose, treat, or predict medical conditions. Please refer to the Terms of Use for more information. You have the choice to contribute and participate in our Services by providing us with your informed express consent.

• What am I consenting to? A consent can be given to participate in de-identified research. If you choose to participate in de-identified research, we will de-identify your data prior to sending it to third party researchers. We de-identify your personal information by stripping all your identifying information (e.g., your name, contact information, etc.) and any other data so that you cannot reasonably be directly identified.

• To Provide You with Research Communications. As a part of the Services, you may receive communication involving external parties (such as academic researchers, healthcare institutions, and other research organizations) that would like to conduct new projects which might be relevant to you. In these circumstances, we may notify you via email about opportunities for which you may qualify. Your participation in such research is completely voluntary. You can always manage your email preferences, but basic research communications are necessary for us to continue to provide our Services to you. Where required by law (for example, for certain outreach or any disclosure of your protected health information to a research sponsor), we will first obtain your consent and/or HIPAA authorization. We do not share your PHI with sponsors/CROs for their own use unless you authorize us to do so.

• We may create HIPAA-de-identified and aggregated datasets from PHI to support research, analytics, and to provide and improve the Services. We do not re-identify such data and require our recipients to implement safeguards, prohibit any re-identification, restrict use to specified purposes, and prevent onward disclosure except under equivalent terms. We de-identify using either Safe Harbor or Expert Determination under 45 C.F.R. §164.514.

3. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?
‍In Short: We may share information in specific situations described in this section and/or with the following categories of third parties.

Vendors, Consultants, and Other Third-Party Service Providers. We may share your data with third-party vendors, service providers, contractors, or agents ("third parties") who perform services for us or on our behalf and require access to such information to do that work. We have contracts in place with our third parties, which are designed to help safeguard your personal information. This means that they cannot do anything with your personal information unless we have instructed them to do it. They will also not share your personal information with any organization apart from us. They also commit to protect the data they hold on our behalf and to retain it for the period we instruct.

Healthcare Providers or Other Entities Authorized by You. With your authorization, we may share your personal information on your behalf with any healthcare provider, entity, or person for research purposes or as otherwise described to you at the time of sharing.

We require providers/centers to use such information only for responding to your request.

4. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?
‍In Short: We may use cookies and other tracking technologies to collect and store your information.

We may use cookies and similar tracking technologies (like web beacons and pixels) to gather information when you interact with our Services. Some online tracking technologies help us maintain the security of our Services and your account, prevent crashes, fix bugs, save your preferences, and assist with basic site functions.

We also permit third parties and service providers to use online tracking technologies on our Services for analytics and advertising, including to help manage and display advertisements, to tailor advertisements to your interests, or to send abandoned shopping cart reminders (depending on your communication preferences). The third parties and service providers use their technology to provide advertising about products and services tailored to your interests which may appear either on our Services or on other websites.

To the extent these online tracking technologies are deemed to be a "sale"/"sharing" (which includes targeted advertising, as defined under the applicable laws) under applicable US state laws, you can opt out of these online tracking technologies by submitting a request as described below under section "DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?”

5. DO WE OFFER ARTIFICIAL INTELLIGENCE-BASED PRODUCTS?
In Short: We offer products, features, or tools powered by artificial intelligence, machine learning, or similar technologies.

As part of our Services, we offer products, features, or tools powered by artificial intelligence, machine learning, or similar technologies (collectively, "AI Products"). These tools are designed to enhance your experience and provide you with innovative solutions. The terms in this Privacy Notice govern your use of the AI Products within our Services.

Use of Session Recording and Analytics.

We use third-party analytics services, including LogRocket, to help us understand how users interact with our website and services. LogRocket records certain interactions, such as page views, navigation, and technical information about your device and browser, in order to identify errors, improve performance, and enhance user experience. These recordings may include usage data and technical logs, but we configure LogRocket not to capture sensitive information such as payment details or protected health information. The information collected is used solely for our internal business purposes, is processed in accordance with applicable data protection laws, and is not sold to third parties.

6. HOW LONG DO WE KEEP YOUR INFORMATION?
‍In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). No purpose in this notice will require us keeping your personal information for longer than two (2) months past the termination of the user's account.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

7. HOW DO WE KEEP YOUR INFORMATION SAFE?
‍In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process.
However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

8. DO WE COLLECT INFORMATION FROM MINORS?

Protected Health Information and Personal Information of Minors

We recognize that certain Services may involve the collection, use, and disclosure of PHI and/or personal information relating to individuals under the age of 18. We take the privacy of minors seriously and apply heightened safeguards to such PHI.

Parental or Guardian Consent

•Our Services are not designed for direct use by minors under 18 without the involvement of a parent or legal guardian.
•A parent or legal guardian must provide consent before we collect, use, or disclose any PHI and/or personal information of a minor through the Services. By permitting a minor dependent to access or use the Services, the parent or guardian represents that they consent to the collection, use, and disclosure of that minor’s PHI and/or personal information in accordance with this Privacy Policy and applicable law.
•Where required, we may also seek written or electronic verification of parental/guardian authorization consistent with HIPAA standards.

Scope of Information Collected

•PHI and/or personal information collected from minors may include medical history, treatment information, care coordination data, and other health-related information provided by health care providers, health plans, or directly by parents or guardians.
•We do not use PHI or personal information of minors for marketing or profiling purposes.

Use and Disclosure

•We will use and disclose PHI of minors solely as permitted under HIPAA, applicable state law, and this Privacy Policy.
Disclosures may occur for purposes of treatment, payment, or health care operations, or as otherwise authorized by a parent/guardian or required by law.

Safeguards and Retention

•We implement administrative, technical, and physical safeguards designed to protect the confidentiality, integrity, and security of PHI and personal information  relating to minors.
•PHI and/or personal information  of minors will be retained only for as long as necessary to provide the Services or as required by applicable law, after which it will be securely destroyed or de-identified.

Improper Collection

•If we become aware that PHI or personal information of a minor has been collected without appropriate parental or guardian consent, we will promptly take reasonable steps to delete such information, disable related accounts, and, if applicable, notify the parent or guardian.

Please note that in certain states, minors may have the right to consent to specific types of health care services (such as reproductive health, mental health, or substance use treatment) without parental involvement. Where applicable law grants such rights, the minor — and not their parent or guardian — controls the PHI related to that care. We comply with all federal and state laws governing access, use, and disclosure of minors’ PHI, including any state laws that provide additional protections beyond HIPAA. Please note that certain state laws give minors between the ages of 13 and 17 the right to consent to specific types of health care services (such as reproductive health, mental health, or substance use treatment). In those cases, the minor — and not the parent or guardian — may control the PHI relating to that care. We comply with all applicable federal and state laws governing minors’ PHI.

In addition, if our Services collect personal information directly from children under the age of 13 online, we do so in accordance with the Children’s Online Privacy Protection Act (“COPPA”), which requires verifiable parental consent. If we become aware that we have collected PHI or personal information directly from a child under 13 without appropriate parental authorization, we will promptly delete such information and disable associated accounts.

No personal information about a child will be made available to the public or sold. We may share information with our service providers if necessary for them to perform business, professional, or technology services for us, always in accordance with all applicable laws including HIPAA.

9. WHAT ARE YOUR PRIVACY RIGHTS?
‍In Short:  You may review, change, or terminate your account at any time, depending on your country, province, or state of residence.

Withdrawing your consent

If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us by using the contact details provided in the section "HOW CAN YOU CONTACT US ABOUT THIS NOTICE?” below.

However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

Opting out of marketing and promotional communications

You can unsubscribe from our marketing and promotional communications at any time by clicking on the unsubscribe link in the emails that we send, replying "STOP" or "UNSUBSCRIBE" to the SMS messages that we send, or by contacting us using the details provided in the section "HOW CAN YOU CONTACT US ABOUT THIS NOTICE?” below. You will then be removed from the marketing lists. However, we may still communicate with you — for example, to send you service-related messages that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with third parties.

Account Information

If you would at any time like to review or change the information in your account or terminate your account, you can:

Log in to your account settings and update your user account.

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms and/or comply with applicable legal requirements.

Most Web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. 10. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.

California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.

Request Verification

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. California "Shine The Light" Law

California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year.
